Quality

10.1. We warrant that on delivery, and for a period of 3 months from the date of delivery (warranty period), the Product shall:
(a) conform in all material respects with its description;
(b) be free from material defects in design, material and workmanship; and
(c) be of satisfactory quality (within the meaning of the Sale of Goods Act 1979)
10.2. Subject to clause 10.3, if:
(a) You give notice in writing to us during the warranty period within a reasonable time of discovery that some or all of the Product(s) do not comply with the warranty set out in clause 10.1;
(b) We are given a reasonable opportunity of examining such Product(s); and
(c) You (if asked to do so by us) return such Product(s) to our place of business at your cost,
We shall, at our option, repair or replace the defective Product(s), or refund the price of the defective Product(s) in full.
10.3. We shall not be liable for Product’s failure to comply with the warranty set out in clause 10.1 in any of the following events:
(a) the Customer makes any further use of such Product(s) after giving notice in accordance with clause 10.2;
(b) the defect arises because you failed to follow our oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Product(s) or (if there are none) good trade practice regarding the same;
(c) the defect arises as a result of us following any drawing, design or specification supplied by you;
(d) You alter or repair such Product(s) without our written consent;
(e) the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; or
(f) the Product differs from its description as a result of changes made to ensure it complies with applicable statutory or regulatory requirements.
10.4. Except as provided in this clause 10, neither we nor our supplier shall have any liability to you in respect of the Product’s failure to comply with the warranty set out in clause 10.1
10.5. The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are, to the fullest extent permitted by law, excluded from the Contract.
10.6. These Terms shall apply to any repaired or replacement Product(s) we supply.
10.7. The warranty set out in this clause 10 is in addition to any other warranty or guarantee to which you may be entitled provided by the manufacturer of any Product(s)
10.8. If you receive damaged or defective products, please contact Chip Chip Customer Services within 7 days of receipt on 03301 232 014 and by email at sales@ChipChip.co.uk  as provided in this clause 10, no unsolicited returns can be accepted.
